Minor Member Personal Information & Processing Notice

This document sets out, in a clear and transparent manner, what personal information is collected for minor members (under 18 years of age), and the purpose and legal basis for collecting and processing that information.

This notice should be read together with the DAN Southern Africa Membership Terms and Conditions and Privacy Policy.

2. Personal Information Collected (Minor Members)

DAN Southern Africa may collect and process the following categories of personal information relating to a minor member:

2.1 Identification Information
  • Full name and surname
  • Date of birth
  • Gender
  • Nationality
  • Identity number or passport number (where applicable)

2.2 Contact & Emergency Information
  • Emergency contact details (parent/guardian and/or alternative contacts)
  • Contact numbers and email addresses (where relevant)

2.3 Membership & Diving Information
  • Membership number and status
  • Diving qualifications and certifications
  • Diving activity information (where relevant to assistance)

2.4 Health & Medical Information
  • Relevant medical history disclosed during application
  • Information shared during an incident or emergency
  • Treatment-related information provided by healthcare professionals

2.5 Incident & Assistance Records
  • Details of diving or non-diving incidents
  • Communication records (calls, emails, reports)
  • Evacuation, treatment, and assistance coordination records

2.6 Guardian Information (Linked to Minor)
  • Parent or legal guardian’s full name
  • Identity or passport number (where required)
  • Relationship to the minor
  • Contact details
  • Confirmation of authority and consent

3. Purpose of Processing

Personal information relating to a minor member is collected and processed for the following purposes:

3.1 Membership Administration
  • To create and manage the minor’s membership profile
  • To provide access to DAN Southern Africa services and benefits

3.2 Emergency Assistance & Coordination
  • To respond to emergencies
  • To facilitate communication with medical professionals and emergency responders
  • To coordinate evacuation, treatment logistics, and related support

3.3 Medical Support (Non-Diagnostic)
  • To provide relevant information to treating healthcare professionals
  • To assist in coordinating care as determined by those professionals

3.4 Safety, Risk Management & Reporting
  • To analyse incidents and improve diver safety
  • To maintain internal records for operational and compliance purposes

3.5 Communication
  • To communicate with the parent or legal guardian regarding membership, incidents, and assistance
  • To provide important safety and operational updates

4. Legal Basis for Processing (POPIA Compliance)

Processing of a minor’s personal information is conducted in accordance with the Protection of Personal Information Act, 2013 (POPIA).

DAN Southern Africa relies on the following legal grounds:

4.1 Consent by a Competent Person
Personal information is processed based on the explicit consent of the parent or legal guardian, who acts as the competent person on behalf of the minor.

4.2 Performance of Membership Agreement
Processing is necessary to fulfil DAN Southern Africa’s obligations in providing membership services, including emergency assistance and coordination.

4.3 Legitimate Interests (Emergency Context)
Processing is necessary to:
  • Protect the life, health, and safety of the minor
  • Enable effective emergency response and coordination

4.4 Legal Obligations
Processing may be required to comply with:
  • Applicable laws and regulations
  • Reporting and record-keeping requirements

5. Sharing of Information
Where reasonably necessary, personal and medical information may be shared with:
  • Treating doctors and medical specialists
  • Emergency responders and evacuation providers
  • Hospitals and healthcare facilities
  • Assistance partners and service providers

All sharing is limited to what is necessary for emergency assistance and related services.

6. Important Clarification
DAN Southern Africa:
  • Does not provide medical diagnoses
  • Does not prescribe or determine treatment
  • Does not act as an insurer or medical scheme
All medical decisions remain the responsibility of qualified healthcare professionals.
